THE FDA SETTLES SUIT !!

In June, 2008, the FDA agreed to settle a lawsuit concerning dental mercury. The first shoe has dropped. Here is the link to the story:

The case is: Moms Against Mercury v. Eschenbach, 07cv2332, U.S. District Court for the District of Columbia.

In the settlement, the FDA agreed to bring to a conclusion by July 2009 a regulatory review of mercury in fillings that began in 2002. The process could result in a requirement that prescribing information warn dentists and pregnant women of nervous system dangers to fetuses and young children with developing brains. "Gone are all of FDA's claims that no science exists that amalgam is unsafe," said Michael Bender of Vermont, a plaintiff in the lawsuit.

The following quotation is taken from this page of the World Health Organization's website. It is an official statement from the Canadian government, which also licenses the use of dental mercury.

"... amalgams contain approximately 50% elemental mercury. Human studies and experiments in laboratory animals indicate that dental amalgam contributes significantly to mercury body burden in humans who have amalgam fillings (IPCS, 1991; US DHHS, 1993; Weiner & Nylander, 1995; Health Canada, 1997)."

THE ADA MAKES A MOMENTOUS DISCOVERY


The ADA, The American Dental Association, recently stopped maintaining the fiction that so-called "silver amalgam" fillings are scientifically proven to be safe. This came about as the result of a court case I will discuss below. What happened is that the ADA found out that so-called "silver amalgams" actually contain 50% mercury and only 35% silver. So, "silver amalgams" are really mercury amalgams. Seeing as the ADA holds the patents for "silver amalgam" fillings this was quite a discovery for them to make. Of course, everyone knows that mercury is deadly poison. The only thing the general public didn't know was that all those beautiful silver-colored fillings in their mouths contained 50% mercury. According to the World Health Organization "...mercury from amalgam fillings is the single greatest source of mercury for the general population..." So, it is no accident that the ADA calls its fillings "silver amalgams" rather than mercury amalgams. The word silver sounds a lot better than the word mercury. As long as they can get away with this deception, what the heck, "open wide". During their court case the ADA actually admitted that mercury fillings may be harmful but it abdicated all responsibility for any damage done by the mercury in their patented fillings. In fact the ADA's website still says "silver amalgams" are safe. Let me see now, safe, not safe, safe, not safe. Let's investigate further the game that the ADA plays with the public. Then you'll be better able to judge how careful you should be the next time you pay a visit to your friendly family dentist, the one who puts mercury in your mouth with the ADA's approval and who has the ADA's good housekeeping seal of approval on the wall. If the ADA changes their website to excise the lies that are there, when they are brought up on criminal charges related to the health effects caused by the mercury in their patented "silver amalgam" fillings the prosecuting attorneys will undoubtedly ask some pointed questions in court about why they changed their site and why they reversed their long-held stance that "silver amalgams" are safe, and why they lied for so long. Changing their website on such an important matter will not absolve the ADA of guilt. On the contrary. The ADA has known about the toxicity of "silver amalgams" since 1859. Disgorging the truth about dental mercury under pressure in court and changing their website will be a de facto admission of guilt. If the ADA doesn't change their site then they'll be even worse off because they will be continuing to flaunt their lies. Either way the ADA will end up losing. That's what the ADA is afraid of. They have no place to hide. They are between a rock and a very hard place, which is better known as the penitentiary.

Let's look at the ADA's website again. "Dental amalgam...contains a mixture of metals such as silver, copper and tin, in addition to mercury, which chemically binds these components into a hard, stable and safe substance." Let me read that again. Amalgam is "...a mixture of...in addition to mercury". Mercury comes at the end of the list. It looks like the ADA is trying to sneak mercury in there at the end without people noticing. According to the ADA, mercury, by far the number one ingredient by weight and volume in "silver amalgams", is the least important ingredient on their list when it should be featured as the most important. Mercury is the single largest ingredient in "silver amalgams" and it is at the end of the ADA's ingredient list. Do you think there is intent to deceive on the part of the ADA? I don't think the ADA would like the sound of that kind "such as" very much at all. That's way too specific. It mentions the word mercury, which is taboo at the ADA. On the ADA's website they talk about what "silver amalgams" are made from. At the end of their ingredient list they casually mention "in addition to mercury", as though a pinch of mercury is thrown in just for flavor at the end of the recipe? Mercury makes up 50% of "silver" fillings. The other metals, including silver, are the additions thrown in for flavor at the end of the recipe. Could the ADA's deliberate deceptiveness be any clearer after reading this sleight of mouth as well as all the other contradictory information disseminated by the ADA on their website and in the lawsuit referred to above? Their intent to deceive is criminal. Never mind. Open wide.

Believe it or not the ADA actually runs a series of weekly cooking classes at ADA headquarters because is has an overstock of mercury. The classes are free of charge and are open to the public. Last week's cooking class was entitled "Mercury cake and cookie recipes: they taste good and they're good for you too!" They're planning to put the whole series of cooking classes on their website really soon. And you'll be able to order the DVD's online. After they talk to their lawyers, of course. You never know what they're cooking up for the public.

There has never been a single study, nor any shred of evidence, to prove the truth of this statement on the ADA's website: "...amalgam...chemically binds these components into a hard, stable and safe substance". There is no scientific proof that that mixing mercury with other metals binds it and, thereby, inactivates it, making it stable and safe. In fact, all the facts prove precisely the contrary which, ironically, the ADA has even admitted in court. Mercury leaches from "silver amalgam" fillings slowly and inexorably, 24 hours a day. Poisoning by slow increments is the result. Death by 1000 cuts is often the result for those whose immune systems are vulnerable and whose genetic make-up is not mercury-resistant. How much mercury has been scientifically shown to leach from "silver amalgam" fillings? The ADA understates the true amount by a factor of 100. That's a nice round number around which they create The Big Dental Lie. Intent to deceive? Let's put it this way. The ADA are professional liars. Why? Because lying = money. They have no intention of ever voluntarily telling the truth about dental mercury. In the end, only public pressure and legal pressure will make any difference to them.

ONCE UPON A TIME THE EARTH WAS FLAT


The ADA cannot produce one single study proving the veracity of their statement implying the inactivation of mercury by mixing it with other metals, because no such study exists. Their statement about the stability and safety of mercury is an out and out lie. The fact is that mercury is not chemically bound in any way to the other metals in "silver amalgam" fillings. Stating that it is chemically bound implies that mercury is not released into the tissues. In fact mercury is constantly released into the tissues, as you will see below. The burden of proof is on the ADA to prove that mercury is safe. They have never proven mercury is safe and will never be able to do so. The ADA's favorite tactic is to claim that mercury is safe, even though it has been known for centuries to be highly toxic. Then they point their finger in the other direction and demand proof from the ADA's detractors that mercury is harmful, which their detractors gladly provide and which the ADA gladly ignores.

The ADA figures if they keep repeating the big lie often enough it will be believed. Like the lie about weapons of mass destruction in Iraq, for instance. Or like the Really Big Lie that was repeated for centuries about the Earth being flat, which everyone believed, including the ADA. Actually, it is a little known fact that the ADA has proof in its files that, contrary to popular belief, the Earth was indeed flat until 1957. No kidding. They don't talk about it very much, of course, and you can't find a page about it on their website.

But here is the ADA's version of the Flat Earth from their archives in Chicago. It is in the same file cabinet as their file on the stability and safety of mercury in "silver amalgam" fillings, coincidently.

"The earth was originally flat, did you know that? It gradually became round over a period of centuries as a result of volcanic activity, tidal erosion, centrifugal force, the Ice Age, tectonic pressure, pressure from the clergy, some hard thinking on the part of a few scientists and philosophers and a great deal of political pressure. Anyway, in 1957 people finally stopped falling off the end of the earth and everybody was very happy about that. The last unfortunate person to fall off the end of the Earth was Harold Finkelstein who was on his way to the 7-11 to buy some hotdog buns in Kalamazoo Michigan on September 13, 1957. Yes, it was a Friday, unfortunately. In case you would like to verify these facts the ADA actually has the information in its files at ADA Headquarters. This all came about because Harold was on his way to the dentist after stopping off at the 7-11 where the local TV station had its camera rolling while interviewing the manager about a recent robbery when Harold was actually caught on camera falling off the edge of the Earth in the 7-11 parking lot. He never made his dental appointment and the ADA bought the film from the local TV station for its archives, in Harold's memory."

Just give the ADA a call or send them an email and they'll be glad to send you a copy of the Harold Finkelstein file and a DVD of Harold falling off the end of the Earth. In case they are having trouble locating it you can tell them Ken Presner sent you and that the file is in the Chicago Headquarters of the ADA in their Archive Department on the 42nd floor, room 67B, row 53, file cabinet #1089, just before the file on the safety of "silver amalgam" fillings.

How many centuries do you think it will take for dental mercury to become harmful? If the ADA has their way it will probably take 300 to 400 years, give or take a few hundred years. That's just a conservative estimate.

The fictitious claim by the ADA that mercury is not released from "silver amalgam" fillings has been proven scientifically false by Dr. Murray Vimy in Calgary. The ADA knows about Dr. Vimy, of course. He was a scientific consultant to the World Health Organization's Committee on Mercury in the Environment. He is a research dentist at the University of Calgary, Alberta, Canada. At first the ADA chose to ignore Dr. Vimy. Later, when they found that wasn't working, they chose to admit that Dr. Vimy was correct but they figured out a different angle. Contrary to all the evidence, they chose to downplay the importance of Dr. Vimy's findings. Dr. Vimy has shown that the mercury from "silver amalgams" is constantly released into the brain and other organs and that when it is released it is just as toxic as before being mixed into "silver amalgams". It is highly toxic. The ADA finally admitted defeat. You can only call chocolate ice cream vanilla ice cream for so long. On the one hand the ADA has acknowledged that mercury leaches from "silver amalgams" fillings but, on the other hand, it has chosen to understate the amount of mercury that leaches from those fillings by a factor of 100. In other words it admits that mercury leaches from fillings but it states that the amount that leaches is only 1% of the true amount. This is only one of many breathtaking lies that the ADA perpetrates. This particular lie is very significant because it shows that the ADA knows how enormously toxic dental mercury is. It could have chosen to downplay it by a factor of, let's say, 2 or 5 or even 10 or 20. But to get mercury levels down far enough so that the ADA would be able to argue them into biochemical insignificance they had to downplay dental mercury by a factor of 100. A factor of 100 is enormous. It changes mercury from being highly toxic into being about as safe as organic carrots. This outrageous lie is actually a de facto admission of guilt by the ADA. It is the "silver amalgam" smoking gun. I wonder what the ADA's lawyers were thinking on that day at ADA headquarters when they invented this special lie. Never mind. Having gone to the trouble of inventing this lie the ADA proceeded to contradict it completely, choosing to deny on its website the fact that mercury leaches from "silver amalgams" at all. Does all this surprise you? The ADA lets the audience choose door #1 or door #2 depending on the occasion, enabling it to lie under oath or lie while not under oath. Its lawyers have created 2 contradictory messages for the ADA, one for each side of its mouth. "White man speak with forked tongue." The fun part is that the ADA has learned to keep a really straight face while telling all their lies.

Did you notice that the word "safe" appears 3 times in the above paragraph entitled "Do you Like Reading Fiction", which was taken from the ADA's website? Notice that this statement contradicts their statements in the lawsuit, below, where they admit the "alleged" dangers of dental mercury while abdicating all responsibility for those dangers. What is one to believe? It looks like the ADA's lawyers forgot to read the ADA website. Maybe their computer was down. Mercury is either "allegedly dangerous" or it is "safe". Which one is it, ADA? The great thing is you can have it both ways if you rely on the ADA for information. If you're foolish enough to even listen to the ADA you can have it anyway you want. You can just make it up as you go along which is what the ADA's lawyers do when they defend the ADA. Do you think their lawyers believe any of the lies they create for the ADA?

You might find it strange to learn that the ADA does not offer certification for the safe and effective use of "silver amalgams" by your friendly neighborhood dentist. It holds the patents on "silver amalgams" but it won't certify its own product. This is a first in the marketplace. The ADA is the first patent holder in history that refuses to back its own product. Their lawyers won't let them, not that they were going to, anyway. Is the ADA afraid that silver which constitutes 35% of "silver amalgam" fillings may be toxic, or is it afraid that mercury which constitutes 50% of "silver amalgam" fillings may be toxic? ADA: "Uh, lemme see. Could you repeat the question please?" The ADA could only certify the safety of its "silver amalgam" fillings by putting its head more firmly into the "silver amalgam" legal liability noose. The ADA is between a proverbial rock and a proverbial hard place. It knows better than anyone that "silver amalgams" are highly poisonous. The ADA is the biggest mercury salesman in the world. If they don't know what's in "silver amalgams" then who does? ADA: "The ingredient list? Uh, lemme see now, here it is, sugar and spice and everything nice. No problem, open wide, please."

The ADA recently filed legal briefs in which it abdicated any responsibility for the damage done by mercury amalgams in Tolhurst v. Johnson & Johnson, a California lawsuit in which a dental patient sued his dentist, two amalgam manufacturers, a distributor and the ADA itself. The brief stated: "The ADA owes no legal duty of care to protect the public from allegedly dangerous products used by dentists. The ADA did not manufacture, design, supply, or install the mercury-containing amalgams. The ADA does not control those who do. The ADA's only alleged involvement was to provide information regarding its use. Dissemination of information relating to the practice of dentistry does not create a duty of care to protect the public from potential injury." Breathtaking, simply breathtaking. The ADA only provides information and is responsible for absolutely nothing in the dental world.

The ADA has great lawyers, don't you think? They have refashioned ADA headquarters in downtown Chicago into an information booth. All the ADA does is give out information. That's the extent of their "alleged involvement" with dental mercury. In fact they are only "allegedly" involved with dental mercury. Even though they hold the patents for "silver amalgam" fillings. One day they will be brought to their knees in court and forced to lie under oath with their hand on the Bible. All they do at ADA headquarters is run back and forth to Kinko's having leaflets printed up about the safety of dental mercury. So help me God. Kinko's really loves the ADA. Oh, I forgot. The ADA also hands out those leaflets at dental clinics while holding the door open for patients. They don't make any money from mercury, they don't control dentists, they are not the biggest dental monopoly in the world, they have no conflict of interest. They only provide information. Breathtaking, simply breathtaking.

And when the ADA gets their information wrong, that's your tough luck, sunny boy. Because the ADA is not even responsible for the accuracy of the information they give out. How could they be responsible for the lies they tell about "silver amalgams"? Be responsible for the lies they disseminate? That's too much to ask of the ADA. Mercury is only "allegedly dangerous", the ADA has no duty to "protect the public from potential injury" and the ADA is only "allegedly involved" in the whole matter. You must admit, that's breath-taking. The ADA has it made. They hold the alleged door open at the alleged dental clinic, they hand out a few alleged leaflets, they don't drop off any alleged mercury, they don't make any alleged bank deposits, and they walk away from any alleged responsibility and all alleged liability. Now that's what I call doing business the allegedly smart way. The ADA has allegedly great lawyers.

But there is a slight problem with all this. If the ADA is only an information provider how does it make all that money, and why is it defending itself against "potential injury" from a product that it says is safe and that, anyway, it claims it has no responsibility for? What is it worried about? Furthermore, even if it had some responsibility in the matter, if "silver amalgams" are safe, according to the ADA site, where is the "potential injury" coming from that the ADA talks about in court? The ADA is running scared. But it has nowhere to run and nowhere to hide. It puts its foot in its mouth at every turn. The truth is there for all to see. One night they will wake up in a cold sweat. The following morning they will find that the truth has finally caught up with them. Until then the ADA's motto remains, What, me worry?

THE ADA IS JUST THE DENTAL DOORMAN


The truth is that the ADA is the dental industry monopoly controlling 70% of the entire dental industry nation-wide. The ADA is the profit engine behind the dental industry. The ADA is the governing body of dentists nation-wide. The ADA makes the policies and rules that govern dentists. But, according to the ADA, they are only in the public service business, providing information to the public, information which may or may not be accurate, about a product they have no responsibility for. Of course, they hide one important piece of information from the public: the fact that the ADA is in the mercury business. The ADA makes its living from selling mercury, from its high-mercury "silver amalgam" patents and from its pay-for-play endorsements. One interesting piece of information the ADA provides the public is that the ADA "does not control" dentists. It just happens to govern most of the dentists nation-wide but it "does not control" them? Did I get that right? Oh, I see. The ADA is just holding the door for the dentists and handing out information leaflets to patients about how safe mercury is. The ADA is just the Dental Doorman. I'll have more to say shortly about how the ADA controls dentists.

It's lucky for the ADA that all this hasn't made it to the Nightly News. But I do recall that a story about "silver amalgams" made it to CBS's 60 Minutes way back in 1990 and caused a huge storm, as you can well imagine, when Morley Safer nailed the ADA to the wall, while the ADA stuttered and stammered about mercury being safely bound in amalgam, and all the other nonsense. The ADA got really mad, no kidding, and they made a few phone calls. And that was the end of that. The show was supposed to be aired a second time. The ADA's lawyers took care of that. Thank goodness. Who the heck does that Morley Safer think he is telling people "silver amalgams" can kill you? Thankfully, the chances are slim to nil this piece of bad news will ever make it to The Nightly News. The ADA's lawyers are working very hard to make sure that never happens. Man, that 60 Minutes scare was bad enough. The blood pressure at ADA Headquarters was way up that day. It was a "gimme-a-valium" kind of day, as you can imagine. Anyway, the ADA's lawyers came to the rescue and everything was soon back to normal, whatever that means.

Let's put it this way: the ADA knows how to tell The Big Dental Mercury Lie with a very straight face to hide its conflict of interest. The ADA is the same as the tobacco companies who hired lawyers to tell people cigarette smoke tobacco is not dangerous for your health. Except mercury is far more toxic than cigarette smoke, of course. One seventieth of a teaspoon of mercury in a 25-acre lake renders all the fish in that lake toxic. You only need a few atoms of mercury to cause neurological damage. One single puff of mercury vapor can kill you. Now that's what I call toxic. Mercury is in a class all its own when it comes to toxicity. That's why your dentist keeps it sealed in water. Until he quickly "places" it in your mouth where the strongest neurotoxin on the planet suddenly and miraculously becomes safe. The ADA is too busy trying to make a living selling mercury to worry about all that. They let their lawyers to create whatever lies they need to tell about dental mercury to fit the bottom line. There is no way the ADA will ever tell the truth about mercury voluntarily. That would be tantamount to committing suicide, and the ADA knows it. It would lose its mercury income, lose its lucrative endorsement contracts, and face criminal and civil lawsuits. It would be out of business and behind bars. Telling the truth would mean game over for the ADA. Lying is their only option. Like I said, they are between a legal rock and a proverbial hard place.

So, how does the ADA solve the problem of their conflict of interest? Problem, what problem? The only solution for the ADA is to act in its own self interest, not in the best interest of its patients. And it does that very, very well. It lies with a straight face to assure its own survival. Some of the ADA's lies are bald-faced while others are lies of omission. But one thing is for sure. The ADA lies with the obvious intent to deceive dental patients. The bottom line is that the ADA wants to keep the mercury profits coming in month after month and year after year. They have made billions of dollars from selling mercury. They are the largest mercury salesmen in the world. The ADA has no intention of giving all that up. So, they have no alternative but to lie through their teeth, excuse the pun, in order to keep the profits rolling in and to save their own skin. Mercury is their product. Lying is their stock in trade. The bigger the lie the better for business. They were not the first to discover this fundamental truth.

Anyway, getting back to the court case, the court agreed that the ADA bore no responsibility for the use of amalgam and dismissed the ADA from the case. Let me catch my breath. Apparently we are expected to ignore, as the court ignored, the fact that the ADA holds the patents on the "silver amalgams" currently in use by most dentists, that the ADA is responsible for certifying all dental schools in the United States, and that the ADA does not encourage cutting-edge dentists to use any product or procedure other than what they were taught in dental school, which includes the main profit-producing high-mercury product the ADA holds the patents for, "silver amalgam" fillings. The court was a complete and utter jackass. They actually agreed with the ADA. Awesome. Boy, did they ever have a party at ADA headquarters that day. They had some mercury left over from their Christmas party so they threw it in the punch. They have just rechristened ADA Headquarters "Mad Hatters Headquarters". The Mad Hatter was the character in Lewis Carroll's Alice's Adventures in Wonderland, published in 1865, who went mad because of the occupational hazard of using mercury to make felt hats. Yes, they knew way back when, just around the time the ADA was founded, that mercury drives people nuts. Dentists have the highest suicide rate of any professional group. Geez, I wonder why?

A FOOL-PROOF MERCURY MARKETING SCHEME


You might find it strange that "silver amalgam" fillings are mysteriously exempt from all safety and labeling laws. You can't sell fish contaminated with mercury. But you can sell "silver amalgam" fillings that are thousands of times more poisonous than toxic fish. Why? Because the government says it's OK. The FDA to be more specific. The FDA in collusion with the ADA. You can't call whole wheat bread "whole wheat bread" unless it contains mostly whole wheat. Right? Then why can you call mercury amalgam fillings "silver amalgam fillings"? We're not talking about whole wheat here. We're talking about mercury, the most powerful neurotoxin on the planet "placed" two inches from the brain being exempt from the labeling laws that bread and chewing gum have to abide by, or else. It's pretty clear that, with all the evidence stacked against it, the ADA had to figure out a mercury marketing scheme. They got together in their board room, they called their lawyers in and they came up with the perfect answer to their problem. Their marketing scheme is known at ADA Headquarters as "Lying with a Straight Face". With the collusion of the FDA, of course, without which the whole game would have been up a long time ago.

The ADA holds the patents on mercury fillings that dentists put in patients' mouths. The dentists that they govern don't hold any patents. According to the ADA's Code of Ethics (remember, the ADA does not "control" dentists"), any dentist who removes a serviceable amalgam filling from a patient, other than an "allergic" patient, for the purpose of removing a toxic substance (mercury) from the patient's body is acting unethically. Let me read that again. If your dentist tells you mercury is poison and suggests you get the mercury out of your mouth your dentist is unethical, according to the ADA, and the ADA can revoke that dentist's license to practice dentistry. Wow, another breathtaking moment brought to you by the ADA. Don't forget, the ADA does not control dentists.

A GREAT CODE OF ETHICS MAKES THE ADA GREAT


The ADA has rules of conduct for dentists. One of its rules compels dentists to stand silent instead of advising patients and the public about the health risks associated with "silver amalgam" fillings. This is The Big Dental Lie by omission. If the dentist does not obey the ADA he can have his license revoked. The ADA is only holding the door? It does not control dentists? If the power to fire dentists is not control, then I don't know what is. That's a great Code of Ethics you have there, ADA. Thank you for helping keep your patients healthy. Oh, sorry, I forgot, they're not really your patients. And you have no responsibility whatsoever toward them. Making the claim that "silver amalgam" fillings are safe has always been preposterous and this constitutes the basis for criminal prosecution of the ADA because the ADA has been acting with intent to deceive. It has been shoveling thousands of tons of mercury into millions of unsuspecting patients' mouths every year in the form of "silver amalgam" fillings while actively deceiving them about the dangers of those "silver amalgam" fillings and not disclosing their conflict of interest to patients. The fact is that the ADA has racked up a death toll unequalled in medical history. It really does have a license to kill. That license was issued by the government. Without government sanction and collusion the ADA would have been behind bars long ago.

Yes, there's a lot of money being made selling mercury to dental patients and the ADA is determined to keep on raking it in, no matter what. One day someone will blow the whistle and the game will be up. One day, the penal code will be enforced and the ADA will be brought up on criminal charges. On that day the ADA will be called to task for its deceit and for the terrible harm it has done. Looking at all the evidence I conclude that the ADA is an association of sociopaths that functions without conscience, outside the morality that normal people possess. I find no other plausible explanation for the ADA's ability to put profit above the health of its patients, enabling it to do so much harm to so many people. Murder is a capital offense. The ADA belongs in jail, without the possibility of parole. To protect the public from the ADA they should throw away the key.
